1. About These Terms

These Terms of Service ("Terms") govern your use of any mobile application published by Marotino CY LTD under the Menusso platform ("Application"). This includes all restaurant ordering apps deployed by Menusso on behalf of its restaurant clients.

By downloading, installing, or using any Application published by Marotino CY LTD, you agree to these Terms. If you do not agree, do not use the Application.

We may update these Terms at any time. Material changes will be communicated via in-app notice or push notification. Continued use of the Application after such notice constitutes your acceptance of the revised Terms.

2. What Is Menusso

Menusso is a SaaS platform operated by Marotino CY LTD. We develop, publish, and maintain mobile ordering applications on behalf of restaurant businesses ("Restaurant Partners"). Each Application you download is branded with a Restaurant Partner's name and logo but is published, operated, and technically maintained by Marotino CY LTD.

Marotino CY LTD is the developer of record on both the Apple App Store and Google Play for all Applications covered by these Terms.

You must be at least 18 years of age to use any Application. By using the Application, you confirm that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

To place an order you may be required to create an account. You agree to:

We reserve the right to suspend or delete accounts that we have reasonable grounds to believe are being misused or that contain materially false information.

6. Placing Orders

When you submit an order through an Application, you are placing a binding purchase order with the Restaurant Partner. By doing so, you confirm that:

An order is confirmed when you receive an in-app or push notification confirmation from the Restaurant Partner. The Restaurant Partner reserves the right to reject any order due to item unavailability, operational limitations, or suspected fraudulent activity. In the event of rejection, you will not be charged, or any charge will be fully refunded.

7. Prices and Menu

Prices are set by the Restaurant Partner and are displayed within each Application in the local currency. Prices include applicable taxes unless otherwise stated. Menu content, item availability, and pricing are managed by the Restaurant Partner and may change without prior notice.

8. Payments

All payments are processed by Stripe, Inc., an independent third-party payment processor. By completing a payment in any Application, you agree to Stripe's Terms of Service and Stripe's Privacy Policy.

For payment disputes or billing inquiries, contact the Restaurant Partner directly via the contact details displayed in the Application, or reach Menusso at [email protected].

9. Delivery

Deliveries are fulfilled by Wolt Drive, a delivery service operated by Wolt Polska Sp. z o.o. and related Wolt entities. Wolt's own terms and policies apply to the delivery portion of your order.

For pickup orders, you are responsible for collecting your order within a reasonable time after the notified ready time.

10. Cancellations and Refunds

Before acceptance: You may cancel your order free of charge if the Restaurant Partner has not yet accepted it. Use the in-app option or contact the Restaurant Partner immediately.

After acceptance: Once the Restaurant Partner has accepted and begun preparing your order, cancellation may not be possible and a refund may not be available.

Approved refunds are returned to your original payment method within 5–10 business days, subject to Stripe and card issuer processing times.

11. Allergens and Dietary Requirements

Restaurant Partners endeavor to provide accurate allergen and ingredient information within their Application. However:

Marotino CY LTD is not responsible for the accuracy of allergen or ingredient information provided by Restaurant Partners.

12. Push Notifications

Applications may send push notifications about order status, promotions, and updates. You can disable push notifications at any time in your device settings (Settings > [App Name] > Notifications). Disabling notifications does not prevent you from using the Application or placing orders.

The Applications, platform, software, and all associated content, trademarks, and trade dress are owned by Marotino CY LTD and/or the respective Restaurant Partners and are protected by intellectual property law. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use each Application solely for personal, non-commercial purposes. No other rights are granted.

15. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy, available at https://menusso.com/privacy, which is incorporated into these Terms by reference.

Marotino CY LTD is not responsible for the data practices, service quality, or terms of these third-party providers.

17. Disclaimers

Applications are provided on an "as is" and "as available" basis. Marotino CY LTD makes no warranty that Applications will be uninterrupted, error-free, or free from security vulnerabilities. To the fullest extent permitted by law, all implied warranties are disclaimed.

Marotino CY LTD is not liable for the acts or omissions of Restaurant Partners, Stripe, Wolt, couriers, or other third parties.

18. Limitation of Liability

To the maximum extent permitted by applicable law:

EU/EEA consumers: Nothing in this section limits mandatory rights you are entitled to under the consumer protection laws of your country of residence, including the right to bring proceedings before your local courts.

19. Termination

Marotino CY LTD reserves the right to suspend or terminate your access to any Application at any time for violation of these Terms or applicable law. You may stop using any Application at any time. Termination does not affect obligations arising prior to termination.

20. Changes to Terms

We may modify these Terms at any time with reasonable notice via in-app notification or posting of updated Terms at https://menusso.com/terms. Continued use after the effective date of changes constitutes acceptance.

21. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Cyprus. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.

22. Severability

If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent necessary, or severed, and the remaining provisions shall continue in full force.
